CALIFORNIA CONSUMER PRIVACY ACT: PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This California Privacy Policy (the “California Privacy Policy”) describes how Konscious Foods Canada Inc. (“Konscious”, “we”, “us” and “our”) collects, uses, discloses, and stores the personal information that a resident of California (“California Residents”) provide or that is provided to us through our websites, including www.konscious.com, as well as any purchase of Konscious’ products, describes the rights of California Residents under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (“CPRA”), and explains how California Residents may contact Konscious to exercise those rights. For the avoidance of doubt, this California Privacy Policy only applies to the personal information of California Residents (i.e., a resident of California).

California Resident Rights

This section describes certain rights of California Residents under the CPRA. For information on how California Residents may contact Konscious to exercise these rights, please see the section below entitled, “How to Submit a Request.”

Right to Know

A California Resident has the right to request that a business disclose what personal information it collects, uses, discloses, sells or shares. Specifically, a California Resident may request that a business that collects personal information about the California Resident disclose to the California Resident the following:

  1. The categories of personal information it has collected about that California Resident.
  2. The categories of sources from which the personal information is collected.
  3. The business or commercial purpose for collecting, selling or sharing personal information.
  4. The categories of non-affiliated entities with whom the business discloses personal information.
  5. The specific pieces of personal information it has collected about that California Resident.

As a California Resident, you may request that a business that sells or shares your personal information, or that discloses it for a business purpose, disclose to you that:

  1. The categories of personal information that the business collected about you.
  2. The categories of personal information that the business sold or shared about you, as well as the categories of third parties to whom the personal information was sold or shared, by category or categories of personal information for each third party to whom the personal information was sold or shared.
  3. The categories of personal information that the business disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose.

Right to Request Deletion

California Residents have the right to request that a business delete any personal information about them that the business has collected. However, we may not be obligated to comply with this request if it is necessary for us to maintain the personal information for certain purposes. If we choose not to delete your personal information when you make the request, we will notify you and explain why the decision was made.

Right to Opt-Out of Sale or Sharing of Personal Information

Konscious does not sell California Residents’ personal information for monetary consideration. However, the collection of data through certain third-party cookies for Konscious’ targeting advertising purposes may be considered a “sale” and is considered “sharing” under the CPRA. While Konscious does not sell California Residents’ personal information for monetary consideration, we do use third party cookies for website analytics and targeted advertising purposes. To opt-out of having your information sold and shared with third party website analytics and digital advertising vendors, click the “Do not sell or share my personal information” link at the bottom of the main webpage.

Please note that the opt-out mentioned above works by placing a web cookie on your computer in order to signify your preference to opt-out from third-party tracking. If you delete your cookies, use a different device or browser when visiting the website, your preference will not be saved. To opt out from other browsers and devices, you will need to repeat the opt-out process in such browsers and devices. If you block the opt-out cookie or your browser is configured to block third-party cookies, then the opt-out cookie may not work. Furthermore, the above opt-out only applies to Konscious’ website and does not impact tracking on third-party websites or with respect to third party content.

Right to Correct Inaccurate Personal Information

A California Resident has the right to request a business that maintains inaccurate personal information about the California Resident to correct that inaccurate personal information, taking into account the nature of the personal information and the purpose of the processing of the personal information.

Right to Limit Use and Disclosure of Sensitive Personal Information

A California Resident has the right to direct a business that collects sensitive personal information as defined under the CPRA about the California Resident to limit its use of the California Resident’s sensitive personal information (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CPRA. Konscious does not collect California Residents’ sensitive personal information.

No Discrimination

A California Resident has the right to not be discriminated against because the California Resident exercised any of their rights under the CCPA. Konscious may charge a California Resident a different price or rate, or provide a different level or quality of goods or services to the California Resident, if that difference is reasonably related to the value provided to the California Resident by the California Resident’s data.

How to Submit a Request

To exercise your rights described above, you must submit a verifiable California Resident request to us. You can do so by calling us at 1.833.333.6715 or emailing us at hello@konscious.com or by contacting us via our Contact Us form. Please be sure to include “CCPA” in the subject line and detail your request in the body of the message.

You may submit a request for personal information as often as you would like, but we are not obligated to respond to requests to provide personal information to you more than twice in any 12-month period.

If you maintain an online account with us, we will verify your identity for a request through the normal account authentication process, meaning you will need to sign on with your username and password.

To submit a verifiable California Resident request, you will be asked to provide certain information to help us verify your identity. If you plan to submit your request via email, we will require you to email us from the email address you previously provided to us or used to communicate with us. For requests submitted online, you will need to confirm the request through the email address you provide in the request form.

You can make a verifiable California Resident request on behalf of your minor child. You can also designate an authorized agent to make the request on your behalf. To do this, you must submit your authorization to us using a verified form of communication, such as through the email address you previously provided to us or previously used to communicate with us.

If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will notify you if we are unable to verify your identity or authority. We will only use personal information provided in a verifiable California Resident request to verify the requestor's identity or authority to make the request.

Personal Information of Minors

Konscious does not knowingly collect or maintain any personal information from any person under thirteen years of age. Our Services are neither directed nor designed to attract anyone under thirteen years of age.
